Duct-Taped Airline Passenger Sentenced to 60 Days in Jail

An Ohio man, Maxwell Berry, was sentenced to 60 days in jail and fined $2,500 and over $1,500 in restitution, in connection with an incident on a Frontier Airlines flight last summer. 

He pleaded guilty in February 2022 in the US District Court in Miami to three counts of assault.

Mr. Berry was duct-taped into his seat on a flight to Miami, after he assaulted and groped two female flight attendants.

He got off easy. The charges could have given him a maximum sentence of one and half years in prison and fines up to $15k.

Berry, who had been drinking alcohol on the flight from Philadelphia to Miami in July of 2021, harassed a flight attendant, walked shirtless down the plane’s aisles, and drunkenly groped one of the flight attendant’s breasts. 

To make matters worse, he assaulted a male flight attendant and had to be restrained by the crew and a passenger, who duct-taped him into his seat. Videos of the scene went viral on social media. One video clip showed Berry screaming, “You guys ___ suck” and talking about his family’s wealth.

In his seat, he continued his unruly behavior, cursing and yelling. As other passengers shouted at him to stop, his mouth was duct-taped in an attempt to silence him. 

Upon landing, the 22-year-old (now 23) was arrested at Miami International Airport. 

Jason Kreiss, Mr. Berry’s attorney, said in a statement to USA Today, “Although we don’t believe 60 days was necessary based on Max’s significant self-reform and other mitigating factors, we respect the judgment of the Court.”
 
The Federal Aviation Administration confirmed at the beginning of May that there have been 1,311 reports of unruly passengers so far during 2022.
