Five New Yorkers are dead and dozens more remain sick after a Legionnaires’ disease outbreak tore through the Upper East Side neighborhoods of Carnegie Hill and Yorkville, with city health officials confirming the fifth fatality on July 21. Of the 87 people who have tested positive for the illness, seven remain hospitalized — and critics are demanding answers about why so many buildings in the affected area had never been properly inspected.
A Neighborhood Under Siege
The outbreak is concentrated in ZIP codes 10028, 10128, and 10075, a stretch of upper Manhattan that includes nursing homes, private schools, and some of the city’s most expensive residential buildings. Of the 87 confirmed cases, 62 people have been discharged, 13 were never hospitalized, and five have died. No new cases were diagnosed after July 15, based on case count data from NYC’s health and mental hygiene agency, which last updated its case count on July 23 at 7:20 p.m.
Among the dead was Robert Goldstein, an 88-year-old retired businessman and Air Force veteran who fell ill on July 2 and died Friday in the intensive care unit at Lenox Hill Hospital. His widow, Ida Goldstein, speaking publicly for the first time since her husband’s death, described watching him suffer on life support every day. She said that knowing a negligent property owner turned the neighborhood into a toxic danger zone, forcing her to breathe in the same air, is an unimaginable horror.
Ida Goldstein said she intends to file a lawsuit once investigators determine which building’s cooling tower was responsible for infecting her husband.
Cooling Towers and Compliance Failures
The city tested 183 cooling towers at 160 buildings across the affected area. Of those, 77 cooling towers at 75 buildings returned preliminary positive results, and 51 cooling towers at 50 buildings were confirmed to harbor live Legionella bacteria through culture testing.
Buildings where live bacteria were detected include addresses along Park Avenue, Madison Avenue, Fifth Avenue, York Avenue, Lexington Avenue, and East End Avenue — among them 920 Park Avenue, 1020 Park Avenue, 1249 Park Avenue, 980 Fifth Avenue, 1001 Fifth Avenue, 1045 Fifth Avenue, 1071 Fifth Avenue, 1080 Fifth Avenue, 1150 Madison Avenue, 1239 Madison Avenue, 1275 Madison Avenue, 1381 Lexington Avenue, 1486 Lexington Avenue, 1750 York Avenue, 1755 York Avenue, 100 East End Avenue, and 180 East End Avenue. All buildings with positive results have undergone remediation and cleaning.
The scope of the contamination suggests there may not be a single source responsible for the cluster, but rather that multiple poorly maintained cooling towers contributed to it simultaneously. That possibility has intensified scrutiny of the city’s inspection and enforcement record. Nearly a quarter of buildings in the affected neighborhoods had no required cooling tower test results on file for 2026 at all — a gap that city regulations were designed to prevent.
Julie Menin, the City Council Speaker whose district includes the Upper East Side, argued the administration’s response was too slow and too cautious. She said the mayor’s office should have proactively disinfected all cooling towers in the area as soon as officials identified the epicenter, rather than waiting for sampling results. The administration countered that disinfecting before collecting samples would have complicated efforts to identify the source. Menin said that each passing hour and day without preventive disinfection of the towers cost more New Yorkers their lives in a tragedy that could have been prevented.
A Pattern of Lax Enforcement
The outbreak is unfolding against a backdrop of deteriorating oversight that predates Mayor Zohran Mamdani’s administration, which took office in January 2026. City enforcement of cooling tower regulations fell to its lowest point in 2021 under then-Mayor Bill de Blasio and hit a second low during the final months of the Eric Adams administration. New Yorkers paid a steep price during those gaps as well: a Legionella outbreak in Harlem the summer of 2025 killed seven residents and sent 24 others to intensive care units. A New England Journal of Medicine investigation published last month found that the cooling tower linked to the 2025 Harlem outbreak had multiple failures in its required monitoring and inspection records, and that the city had taken no action to force compliance.
Critics have not spared the current administration. Betsy McCaughey, writing in the New York Post, argued that the city bears direct responsibility for the deaths. She wrote that five New Yorkers have been killed by the latest Legionella outbreak, and with victims still hospitalized, the death toll may rise. McCaughey accused Mayor Mamdani and Health Commissioner Dr. Alister Martin of failing in a basic duty of governance while pursuing other priorities, and noted that 12% of people who contract a Legionella infection die within 30 days — making enforcement not a bureaucratic nicety but a matter of life and death.
Officials Defend Response, Warn of Risk Factors
Health Commissioner Dr. Alister Martin defended the city’s handling of the outbreak, saying officials moved aggressively once the cluster was identified. He said testing and remediation efforts had likely eliminated the exposure source and that investigators are continuing to analyze laboratory results and pursue enforcement actions against any building owners found out of compliance. Mayor Mamdani said he believes the source of exposure has been eliminated and pledged that cooling tower inspections and health law enforcement would continue.
Health officials have urged anyone who lives, works, or has visited the affected ZIP codes since late June and is experiencing flu-like symptoms — including cough, fever, or difficulty breathing — to contact a health care provider immediately. People at elevated risk include those 50 or older, smokers, and those with chronic heart, lung, kidney, or liver disease. Legionnaires’ disease is not contagious and cannot be spread from person to person. It cannot be contracted by drinking tap water or using a home air conditioner; exposure occurs by breathing in water vapor — typically mist from a contaminated cooling tower — that carries the bacteria.
