President Donald Trump unleashed a furious social media tirade against the Supreme Court in the early hours of Monday morning, April 6, 2026, attacking the justices at 1 a.m. as the court weighs his effort to end birthright citizenship.
The 79-year-old president suggested in his Truth Social post that it was “too bad” the Supreme Court didn’t “study” Fox News host Mark Levin’s show, in which Levin argued the 14th Amendment was never intended to grant citizenship to children of undocumented immigrants.
The late-night outburst came days after Trump made an unprecedented appearance at the Supreme Court for oral arguments on his birthright citizenship case. He became the first sitting president ever to attend such a session—and left abruptly after about 90 minutes, departing silently while justices questioned the ACLU attorney opposing his executive order.
Inside the courtroom, several conservative justices—including those Trump appointed during his first term—aggressively questioned Solicitor General D. John Sauer’s defense of the executive order. One sharp exchange came when Roberts pushed back after Sauer suggested the framers of the 14th Amendment could not have foreseen modern circumstances.
“It’s a new world. It’s the same Constitution,” Roberts replied.
Trump’s frustration extends beyond birthright citizenship to the court’s February ruling that struck down his sweeping global tariff scheme. The court ruled 6-3 that Trump exceeded his authority by imposing tariffs using the International Emergency Economic Powers Act, a 1977 law designed to address national emergencies. Chief Justice John Roberts authored the majority opinion, joined by Trump appointees Neil Gorsuch and Amy Coney Barrett along with the three liberal justices.
The president reserved particular venom for Republican-appointed justices who ruled against him, contrasting them with Democratic appointees Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson. In his overnight post, Trump complained that Republican justices “openly disrespect the Presidents who nominate them” while “Democrat Justices just vote Democrat.”
The White House inadvertently exposed more of Trump’s fury when it posted and quickly deleted footage from an Easter luncheon with MAGA pastors on April 1. In the hour-long recording, captured by Business Insider reporter Bryan Metzger before deletion, Trump lashed out at justices he appointed, calling them “stupid people” for trying to prove their independence by ruling against him.
The president also attacked Supreme Court justices during a fundraising dinner at Union Station in Washington, D.C., telling Republican donors that Gorsuch and Barrett “sicken me” for voting against his tariff plan. He called the February ruling “an embarrassment to their families.”
Levin, whose show Trump cited in his overnight post, has a law degree from Temple University but has never argued before the Supreme Court. The 68-year-old conservative commentator built his career as a contributor to Rush Limbaugh’s radio show before landing his own program and later a show on Fox News.
Section 1 of the 14th Amendment states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
Trump’s executive order attempting to end birthright citizenship has been struck down by every lower federal court that considered challenges to it. Legal experts widely view the policy as unconstitutional, and the conservative Supreme Court appeared highly skeptical during oral arguments.
The president’s attacks on the judiciary represent a sharp departure from historical norms. Chief Justice Roberts appeared to address Trump’s rhetoric during a public appearance at Rice University in March, though he did not mention the president by name.
“Personally directed hostility is dangerous, and it’s got to stop,” Roberts said.
Trump concluded his early morning rant by declaring: “This completely inept and embarrassing Court was not what the Supreme Court of the United States was set up by our wonderful Founders to be. They are hurting our Country, and will continue to do so.”
